Terms and Conditions of Sale
Returns for Incorrectly Shipped Products
Queensland Business Machines does not accept product returns for any reason unless the product has been mis-shipped or arrives DOA (dead on arrival - that is, not working - does not power up etc...). A product is only mis-shipped when a materially different product from the product you ordered has been delivered. Any mis-shipped product that is returned must be in original, unopened condition. No product returns are accepted where packaging has been opened, written upon, or damaged in any way.
All Other Product Return Enquiries
Queensland Business Machines does not accept product returns under any circumstances unless the product is DOA or falls within the ambit of the conditions below. In the event that you receive a product that does not meet your expectations, your complaint should be directed to the Directors of Queensland Business Machines. Customers should select products very carefully. Queensland Business Machines is not responsible for mis-selection of goods by customers. All products are sold on a No Return basis and incur a 15% restocking fee. We are happy to assist you with your enquiries regarding product specifications, but we assume no responsibility for claims made by manufacturers which may be found by customers to be inflated, or incorrect.
Printer Consumables Returns
Will only be accepted if the products are in their original packaging, unopened, of a current make and model, and otherwise as new and in a saleable condition within two (2) months of invoice date.
Service
Queensland Business Machines reserves the right to dispose of uncollected equipment after 90 days upon receipt into workshop. A quote fee of $132 applies should you decide not to go ahead with the initial repair.
Retention of Title
Title to the goods does not pass to the buyer until payment in full is received by Queensland Business Machines from the buyer and the buyer must:
- store goods which have not been paid for separately;
- keep separate records in relation to the proceeds of the sale of any goods which have not been paid for, bank the proceeds of any such sale into a separate account and immediately remit such funds to the credit of Queensland Business Machines; and
- if any goods are used in a manufacturing process or mixed with other materials, the buyer must record the value of goods so consumed in relation to each unit of finished product and upon sale of any unit of finished product immediately remit that amount from the proceeds of sale to Queensland Business Machines.
If the buyer does not pay for any goods on the due date specified in this agreement then Queensland Business Machines is irrevocably authorised by the buyer to enter the buyer's premises (or any premises under the control of the buyer or as agent of the buyer if the goods are stored at such premises) and use reasonable force to take possession of the goods without liability for the tort of trespass, negligence or payment of any compensation to the buyer or anyone claiming through the buyer whatsoever.
Freight
Customers using QBM freight carriers do so at their own risk. QBM does not cover damaged or lost goods. Insurance on all goods are available at a cost incurred by the customer. A quote is available on request. The customer must notify Queensland Business Machines in writing of any claim within the following time limits: where the receiver had indicated in writing on the consignment note that loss or damage has occurred in respect of the Goods, within fourteen (14) days from the date of delivery of the Goods to the delivery address; and, where the receiver has acknowledged that the Goods have been delivered and received in good order and condition, within twenty-four (24) hours from the date of delivery of the Goods to the delivery address.
Note
We will do everything in our power to assist customers get their products working to their satisfaction. Excellent service must, ultimately, be paid for - either that, or the business will not remain in existence for any extended length of time. We intend to remain in business to support you in the future. Management reserves the right to offer refunds on purchases where appropriate. None of these terms exclude any statutory warranties or non-excludable rights.
